Legal review of expert evidence in a criminal case

Legal review of expert evidence in a criminal case: source materials, assumptions and reasoning, followed by questions and a procedural position for the defense.

Examining expert evidence

Expert reports may address traffic accidents, injuries, property values, documents, recordings or digital data. The review examines how the questions and source materials relate to the report’s reasoning and final answers.

The attorney considers the report alongside the other evidence and procedural records. Where specialist knowledge is needed, involvement of an appropriate expert can be discussed separately.

Scope of the review

  • The questions, documents and objects supplied for the examination.
  • Identification, provenance and available storage records for the objects.
  • The distinction between established facts, assumptions and conclusions.
  • Internal inconsistencies and differences from other case evidence.
  • Questions for the expert and potential further procedural steps.

Documents to prepare

  • The complete report with all attachments, tables and illustrations.
  • The examination request or order and the list of supplied materials.
  • Relevant inspection records, photographs, recordings and other reports.
  • The case stage, procedural status and next hearing date.

Questions

Q.Is this a new forensic examination?

No. This is legal work on the evidence and the defense position. Any separate specialist examination and expert involvement must be agreed independently.

Q.Is the final page of the report enough?

A meaningful review requires the complete report, attachments and available source materials.

Q.Can work begin with incomplete documents?

Yes. The initial task can identify the missing materials and the limits of a preliminary assessment.

Q.Does an identified error guarantee a particular outcome?

No. The agreed deliverable is the review and preparation of the defense position, not a predetermined decision in the case.
